China Further Optimizes the Requirements for Exporting Cosmetics Containing Triethanolamine (TEA) to China

On January 25, 2024, China’s Ministry of Industry and Information Technology (MIIT), Ministry of Commerce (MOFCOM), and the General Administration of Customs (GACC) jointly announced the removal of the import license requirement for products containing low-concentration Triethanolamine (CAS No. 102-71-6), including cosmetics. This adjustment will become effective on February 1, 2024.

For exporting cosmetics containing TEA to China, regardless of the concentration, it is mandatory to apply for the Import License for Dual-use Items and Technologies. It takes about one and a half months for the whole application process, whose valid period is not more than one year in general.

China GACC Modifies Declaration Requirements for Imported Cosmetics

China (GACC) released an announcement modifying the declaration requirements for some imported cosmetics. 1 When the consignee of imported cosmetics and their agents declare cosmetics whose HS code starts with 3303 and 3304, they should fill the product quantity in the customs declaration form according to the following requirements.

China Customs Rejected Imported Cosmetics Containing Cannabis Sativa Seed Oil

From 2021 to April 2022, China Customs: 1) rejected a total of four batches of cosmetics containing cannabis sativa seed oil from entering China; 2) seized three bottles of CBD essential oil containing THC. The suspects were arrested.

China Updates Cross-Border E-Commerce Positive List

The List of Import Goods through Cross-border E-commerce (2022 Edition) amended the remarks of 11 cosmetic products. They shall not be listed in the Catalogue of Commodities Prohibited from Import (Seventh Batch) and require certificate to prove that they do not belong to Wild Fauna and Flora Import/Export Commodity Catalogue.

China Implements Amended Cosmetic Prohibited Ingredient Inventories: 24 Newly Prohibited Ingredients Including Cannabidiol (CBD)

The main amendments include adding 24 prohibited ingredients, amending the names and CAS numbers of prohibited ingredients, classifying and merging prohibited drug ingredients. From May 28, 2021, cosmetic registrants and notifiers are not allowed to produce or import products containing prohibited ingredients stipulated in the new inventories. Among the 24 newly prohibited ingredients, CBD and three other Cannabis Sativa derived ingredients are included, which means that CBD cosmetics are prohibited from being produced and imported in China.
