Ensure Compliance with China's New Toothpaste Notification Regulations

On September 25, 2023, China National Medical Products Administration (NMPA) issued an announcement regarding the implementation of toothpastes supervision regulations and the simplification of notification document requirements for toothpastes already available in the market. According to the announcement, toothpaste manufacturers whose products have no incidents related to quality and safety, and are with comprehensive evidence of their history of safe usage can undergo simplified notification from October 1, 2023, to November 30, 2023. Products that have completed the simplified notification can continue to be imported and sold after December 1.On the same day, NMPA released the Provisions for Management of Toothpaste Notification Dossiers. This is the first update to the notification requirements for toothpaste in over two years since the release of the draft Instructions for Toothpaste Notification Dossiers. Compared to the initial draft, the updated version provides more detailed provisions for each notification requirement, aligning closely with the requirements for cosmetics notification management. There have been some additions and deletions regarding the notification application form, basis for product naming, product formula, product labeling, product executive standards, product testing report, product safety assessment documents, and other aspects.As revealed by the Administrative Measures on Toothpaste, starting from December 1, 2023, domestically produced toothpaste must be notified with the provincial-level drug supervision and administration department in the jurisdiction of the notification applicant before being marketed and sold. Imported toothpaste must be notified with the NMPA before importation. We are now very close to the launch of toothpaste notification management, and gaining a detailed understanding of this draft can provide significant references for preparing the notification documentation. China Cosmetic Ingredient Submission Code Application – Latest Updates and Practical Guidance

The Provisions for Management of Cosmetic Registration and Notification Dossiers that came into force on May 1, 2021 requires cosmetics registrants and notifiers to provide safety-related information about the ingredients used in their products during registration or notification. To simplify the application process, NMPA has introduced the ingredient submission code, which allows registrants or notifiers to fill in the code and directly associate the ingredient safety information, without the need to upload related documents by themselves.However, the regulations surrounding the ingredient submission code have undergone several changes since its introduction. The most recent update to the management measures for the code was released on March 27, 2023. Efficacy Claim Evaluation Focus: New Cosmetic Compliance Requirements under China's CSAR

Before the Cosmetic Supervision and Administration Regulation (CSAR) was released in China, only sunscreen efficacy and the waterproof efficacy of sunscreens were required to be evaluated in accordance with Safety and Technical Standards for Cosmetics 2015. For other efficacies of cosmetics, there is no mandatory requirement, and the testing methods for ready reference are also limited. Under this background, consumers have no access to the supporting materials of cosmetic's claimed efficacy, while cosmetic enterprises lack methods to convince consumers.Responding to this situation, in CSAR, NMPA specifies that cosmetic's efficacy claims shall be supported by sufficient scientific basis, and requires to publicize the summary of cosmetic efficacy evaluation. Later on April 9, 2021, NMPA issued the finalized Standards for Cosmetic Efficacy Claim Evaluation, rolling out a detailed plan to standardize and guide the evaluation of cosmetic efficacy claims. The implementation of these new requirements reflects China's increasingly comprehensive supervision on cosmetics. But at the same time, the strict compliance requirements have posed challenges to cosmetic enterprises. CSAR Series: Decoding China’s New Cosmetic Labeling Regulation

Non-compliant cosmetic labeling is the primary reason for customs rejection in 2021, and the common reason for the failure of cosmetics registration/notification review and post-market inspection. Relevant enterprises may face administrative penalties such as corrections within a time limit, fines, etc., resulting in economic losses.On June 3, 2021, China NMPA issued the finalized Administrative Measures on Cosmetics Labeling, spelling out the requirements for the labeling and prohibited claims of cosmetics (including cosmetics provided to consumers in the form of trial, gift, exchange, etc.) under China's new cosmetic regulations. The Measures will be implemented on May 1, 2022. CSAR Series: Introduction of China's First Children Cosmetics Regulation

In China, compared with adult cosmetics, children cosmetics occupy a small share of the market. But spurred by the consumption upgrade and the introduction of the two-child and three-child policy, China’s children cosmetics market has grown rapidly in recent years and is expected to continue in the future. Mintel estimates that China’s infant care products (aged from zero to three years) market will grow from 7 billion yuan in 2016 to 17.6 billion yuan in 2021.However, the fast-growing market also brings more irregularities, such as the illegal addition of prohibited ingredients, unlicensed production, etc. Aimed at this condition, China NMPA ramped up the supervision on children cosmetics, and promulgated the Supervision and Administration Provisions on Children Cosmetics on Oct. 8, 2021, which is China’s first regulation specifically for children cosmetics and will come into force on Jan. 1, 2022. The Provisions imposes the most stringent regulatory requirements on children cosmetics, such as labeling of the specific mark, mandatory animal testing, prohibition of functional ingredients and food-related claims.
