How does Taiwan regulate cosmetic ingredients?

Taiwan has created five cosmetic ingredient lists with a structure similar to those of the EU and ASEAN for regulating cosmetic ingredients, which are as follows:

1) List of Ingredients Prohibited in Cosmetic Products

2) List of Ingredients Restricted in Cosmetic Products

3) List of Colorants in Cosmetic Products

4) List of Preservatives in Cosmetic Products

5) List of UV Filters in Cosmetic Products

Is it possible to use a colorant, preservative, or UV filter not authorized by Taiwan’s competent authority?

Yes. For colorants, preservatives, and UV filters not included in Taiwan’s cosmetic ingredient lists, if the competent authorities of the EU, the United States, and Japan have announced their approval for use and established applicable regulations, then these ingredients can be used in cosmetics in accordance with those standards.


However, this rule does not apply to the following 19 colorants: CI 11380, CI 11390, CI 12100, CI 12140, CI 12315, CI 13065, CI 14600, CI 16150, CI 16155, CI 18950, CI 21090, CI 26105, CI 42052, CI 42052:1, CI 42085, CI 42095, CI 45440, CI 45440, and CI 61520.

Are there any restrictions on using hemp seed oil in cosmetics?

According to the List of Ingredients Prohibited in Cosmetic Products, tetrahydrocannabinols are prohibited for use in cosmetics. In cosmetics that contain cannabis sativa seed oil (hemp seed oil) as an ingredient, tetrahydrocannabinols concentrations in the final products shall not exceed 10 ppm.

 

Besides, pharmaceutical ingredients (including controlled drugs) that have not been publicly announced or approved by the central competent authority are prohibited in cosmetics. As cannabidiol is currently regulated as a pharmaceutical ingredient in Taiwan, it is also prohibited in cosmetic products.

Are human stem cells or related extracted ingredients permitted in cosmetics?

As per the List of Ingredients Prohibited in Cosmetic Products, cells, tissues or products of human origin are prohibited in cosmetics, except for specific exosomes-related cases that have been reviewed and approved by the competent authority. Effective from March 21, 2024, for case review, the applicant should submit relevant documents or information, including the qualifications of the exosome donor, preparation processes and inspection reports, stability tests, safety tests, as well as absorption, distribution, metabolism, and excretion tests.
