On January 22, 2026, the U.S. Food and Drug Administration (FDA) released a draft guidance entitled FDA Records Access Authority for Cosmetic Products to clarify its expanded authority to access and copy records related to cosmetic products. The guidance is intended to support the implementation of the Modernization of Cosmetics Regulation Act of 2022 (MoCRA) and explains how the FDA plans to exercise its records access powers under the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Although the guidance is non-binding, it reflects the FDA's current regulatory thinking and provides important compliance signals for the cosmetics industry. Stakeholders may submit public comments until March 23, 2026.
