These Implementation Rules are formulated pursuant to Article 34 of the Regulations concerning the Hygiene Supervision over Cosmetics. (Article 34 The right to interpret these Regulations resides in the health administration department under the State Council and the rules for the implementation of these Regulations shall be formulated by the health administration department under the State Council.)
Therefore, these detailed rules are supplement for the Regulations concerning the Hygiene Supervision over Cosmetics, which specify review and approval procedures of hygiene license for production enterprises of cosmetics, special use cosmetics and imported cosmetics, required application documents and corresponding obligations when enterprises decide to manufacture a new kind of cosmetic product or establish a new branch and so on. In the end, 9 kinds of special use cosmetics are defined.
Since the hygiene administration departments at or above county government level will conduct examinations on enterprises that already have hygiene license on a regular basis or irregularly, the concrete examined items and penalties if enterprises are found to violate rules are also stated.
With the reinforcement of management on cosmetics and growing demand of hygiene and quality of cosmetic products, Ministry of Health drafted Measure for the Administration of Production Enterprises of Cosmetics Licensing and State Food and Drug Administration (SFDA) released Requirements for Application and Acceptance of Administrative Licensing for Cosmetics to assist manufactures to apply for hygiene licenses for company and cosmetics, in which documents and duties are more detailed and have higher demand.
