China NIFDC Clarifies Detailed Registration Requirements for Special Cosmetics and New Cosmetic Ingredients

On June 5, 2023, China National Institutes for Food and Drug Control (NIFDC) released nine guidelines pertaining to the registration of Chinese domestic and imported special cosmetics, as well as high-risk new cosmetic ingredients (NCIs). These guidelines provide clear details and time limits for the first registration, registration change, registration renewal and registration cancellation applications, which are highly informative for enterprises seeking guidance.

Deadline Approaching: Cosmetic Companies Shall Update Product Labels and Supplement Efficacy Evaluation Summary by May 2023

For cosmetics that were registered or notified before May 1, 2022, the registrants or notifiers must update the product label in accordance with the Administrative Measures on Cosmetics Labeling by May 1, 2023; For cosmetics that were registered or notified before May 1, 2021, the registrants or notifiers must evaluate the efficacy claims in accordance with the Standards for Cosmetic Efficacy Claim Evaluation and upload the summary of the evaluation before May 1, 2023; For freckle-removing (whitening) and anti-hair loss cosmetics registered before May 1, 2021, the registrants must supplement a human body efficacy evaluation testing report before May 1, 2023.

[Updated] CSAR Subsidiary Regulations: China Implements the Strictest Cosmetic Sampling Testing Regulation

In September 2020 and June 2022, China National Medical Products Administration (NMPA) issued two drafts of Measures for the Management of Cosmetic Sampling Testing. Finally, on January 12, 2023, NMPA released the finalized Measures, which was implemented on March 1, 2023. The Measures is divided into 8 chapters and 61 articles, providing detailed requirements on the formulation of sampling testing work plan, sampling, testing and result submission, objection and re-testing, verification and disposal of unqualified products, as well as information disclosure. Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
