Public Consultation Resumed for New Draft of Cosmetic Safety Technical Standard

Amendments to the new draft of Cosmetic Safety Technical Standard have kicked off the second phase of public consultation after the first ended this February. The Registration Division of CFDA released a notice on 12 August, calling for the bulky guidance to undergo a further round of public feedback before 1st of September.

The new draft is accompanied by a compilation manual and a comment-soliciting sheet. Feedback should be sent by email to: hzpbwh@nifdc.org.cn.

Since September 2008, when CFDA (formerly SFDA) took over as the main government body regulating cosmetics in China, regulatory efforts have been scaled up in response to a series of scandals. The Cosmetic Safety Standard, previously known as the Cosmetic Hygiene Standard, has garnered serious attention from policymakers due to major inadequacies. The project was undertaken in a coordinated fashion with support from the National Institutes of Food and Drug Control (NIFDC), a technical arbitration institute in China for inspection of drug and biological product quality.

The draft amendment is divided into a number of sections including framework, scope, definition, general requirements along with an appendices section which includes two ingredients lists and another 5 lists containing permitted and required testing methods and protocols. The inclusion of an appendix detailing alternatives to animal testing is conspicuously absent from the new draft.

The new version contains only minor changes in comparison to its predecessor, most notable of which is the addition of the lists of colorant and hair dye according to Martin Hu, Technical director of Cosmetic Department of REACH24H. According to Mr.Hu “What’s really worth noting is how the Chinese standard compares with that of EU”, “it’s been aligned with “Commission Regulation (EU) No 483/2013” and “Commission Regulation (EU) No 1003/2014” in certain parts” but Mr.Hu also concedes that China’s cosmetic legislative and regulatory framework had a lot to do before it catches up with international best practices.
