Shanghai to Implement New Provisions for On-site Personalized Cosmetic Services in August

Consisting of 34 Articles, the Trial Provisions mainly introduces the qualifications for enterprises which intends to apply for the licensing of on-site personalized cosmetic services, and mandatory obligations for the enterprises involved from five aspects.

On July 20, 2023, Shanghai Municipal Medical Products Administration (MPA) released the Provisions for Management of On-site Personalized Cosmetic Services in Pudong New Area of Shanghai (Trial) (the Trial Provisions) to further standardize the personalized services. The Trial Provisions will take effect from August 20, 2023, and be in effect for two years until August 19, 2025.1

The Trial Provisions applies to notifiers and Chinese domestic responsible persons who have set business premises in Pudong New Area, and offer on-site packaging and sub-packaging in accordance with consumers' individual needs for their notified general cosmetics, excluding children cosmetics, eye cosmetics, and cosmetics with new ingredients. Consisting of 34 Articles, it mainly introduces the qualifications required for conducting personalized services, and the mandatory obligations for the enterprises involved.

Notifiers or the authorized Chinese domestic responsible persons, if belonging to the same group company as the notifiers, are eligible to apply for the licensing of personalized services to the Pudong New Area Administration for Market Regulation. These enterprises shall provide documents proving their identification and fulfilment of the following conditions as the application materials:

  1. Capable of conducting full-process risk evaluation and control of personalized services and products, as well as monitoring and evaluating the adverse reactions to products;

  2. Equipped with suitable premises, environmental conditions, as well as service and testing facilities and equipment;

  3. Have competent technical and testing personnel;

  4. Have effective management systems to ensure cosmetic quality and safety, in the aspects of material acceptance, quality control, product testing, sample retention, etc.

Obligations for Enterprises Offering Personalized Services

To guide enterprises to offer adequate personalized services, the Trial Provisions specifies the obligations for them from five aspects, as shown in the table below.
