The purpose of this decree is to prescribe matters delegated by the Cosmetics Act and other matters necessary for the enforcement.
This regulation includes:
Detailed types and scope of business
Standards for calculation of penalty surcharge
Procedures for imposition and collection of penalty surcharges
Disposition against payer in arrears of penalty surcharge
Publication of relevant violations
Delegation of authority, treatment of sensitive information and unique identifiable information
Standards for imposition of administrative fines

On April 27, 2021, MFDS (Ministry of Food and Drug Safety) revealed the amended Enforcement Decree of Cosmetic Act. The new version permits the payment prolonging and the installment payment of a penalty. Under certain circumstances where the obligor has difficulty paying the penalty at once, he/she could apply to extend the payment due date or pay by installments. This provision is aimed to ease the industry's burden under the COVID19. It was praised as a humanitarian policy ever since its draft was released last year.
