US MoCRA Compliance Focus: Major Updates and Steps for Being Prepared

Background

Following the enactment of the Modernization of Cosmetics Regulations Act of 2022 (MoCRA) on December 29, 2022, the US FDA has taken significant steps to facilitate its implementation. These efforts include the launch of the Cosmetics Direct Electronic Portal, the introduction of the Industry Guidance on Facility Registration and Product Listing, and more. According to the FDA's latest compliance policy, all initial facility registrations for the facilities that first engaged in manufacturing or processing a cosmetic product after December 29, 2022, and product listings for the cosmetic product that first marketed after December 29, 2022, must be submitted by July 1, 2024. Hence, companies are required to take proactive measures to ensure compliance.
