China to Improve the Quality of Cosmetics Used by Beauty and Hair Salons

In order to enhance the quality and safety of cosmetics used by beauty & hair salons nationwide, China SFDA on 8 Jan 2013 started to consult on a draft guidance for food and drug departments to carry out daily supervision on the beauty shops, which will mainly focus on the following aspects.

  •  Qualifications

    1. All cosmetic products must be produced by manufacturers with hygiene licenses obtained from provincial food and drug administrations.

    2. Besides, different categories of products must have their own license numbers:

    Domestic/imported special use cosmetics

    Approval number on the

    administrative license

    Imported non-special use cosmetics

    Record filing number on the

    record filing certificate

    Domestic non-special use cosmetics

    Record filing certificate

    3. The sanitary certificates of inspection and quarantine of imported cosmetics should be within the validity period and the date of production should be within the expiration date specified on the license.

  •  Labeling and instructions for use

    1. The names of all checked cosmetics are required to be in compliance with related national regulations, such as Requirements on Naming of Cosmetics, Guide to the Naming of Cosmetics and GB 5296.3-2008.

    2. Labels must be printed with the name, address, hygiene license number of cosmetic manufactures, production data, shelf life, etc.

    Imported cosmetics need to bear standard Chinese labels with the original country, distributor, importing unit, agent in China included.

    3. Ways of use and warnings must be stated in the instructions for use of cosmetics that may cause adverse reaction.

  •  Quality

    The officials will check whether the products have expired and have testing reports or the certificates of inspection and quarantine (for imported cosmetics).

  •  Storage and sanitary conditions of salons

    The working places should be clean and equipped with facilities for ventilation and preventing dust, humidity, insects and rats.

  •  Advertising of cosmetics

    Wordings like cosmeceutical and medical skin care products which exaggerate functions, effects, medical terms and indications are prohibited for promotion, according to the Measures for the Administration of Cosmetic Advertising,

  •  Adverse reaction disposal and report

    Salons workers need to keep every undesirable reaction on record and report to the local food and drug departments along with suppliers.

At the very beginning of 2013, the SFDA has released three opinion-soliciting drafts continuously in regard to the establishment of an supervisory information system to monitor cosmetic manufacturers (see Chemlinked news on 10 Jan 2013 ) and an electronic risk monitoring and early warning platform as well as reinforcement of supervision on quality in beauty and hair salons as well as, which indicate the government’s determination to intensify post-market surveillance. The cosmetic manufacturers need to be fully aware of their responsibility to have products made in line with relevant regulations and standards.

For any comments on this draft, you are required to submit them to the SFDA before 22 Jan 2013.
