How to become a company in the red list?

According to the new administrative methods, companies should proactively apply to add their names in the red list which will mean they are designated as a credible manufacturer. Their applications will be reviewed by Zhongshan FDA, and then their names will be added to the red list if they pass the review.

Companies with no safety or compliance violations in the last two years that meet the following three requirements will be qualified to be added to the red list.

Companies designated as “Class A Companies” or “Standard Companies” with high credit rating by FDA;
Companies have been publicly praised by governments or relevant departments at prefectural level;
Companies that have been officially issued with awards by industrial organizations recognized by the FDA due to significant contribution to the industry.

What is the benefit of being a “red list company”?

According to this new administrative system when red listed companies apply for a license from FDA, they will have be given priority and the process will be accelerated. The “red list companies” will also have the opportunity to be recommended by government.

How a “black list company” will be treated?

Meanwhile, companies which violate laws, regulations or rules about food, drug, medical instruments and cosmetics, and have been issued with administrative penalties will be added to the black list.

The red list and black list will be announced via the official website of Zhongshan government, website of Credit Zhongshan and various media each quarter. The announcement of the black list will include information like name and address of the company, name of the legal representative, and the main violation behaviors. In addition, the product name, specification, batch, label, authentication code and production license number of the products involved will also be published.

The “black list companies” could be removed from the list if they have no other violations within a one-year restriction period. However, their previous violation will still be recorded. During the restriction period, the supervision departments can conduct random inspection of safety management reports from the “black list companies”. The frequency of inspection and spot check for these “black list companies” will also be increased. If these companies violate safety and compliance regulations during the restriction period, they will be severely punished. Zhongshan FDA also encourages social organizations and individuals to supervise the “black list companies”.
