On October 14, 2020, the European Commission published the Chemicals Strategy for Sustainability to achieve the ambitious environmental convention of the European Green Deal, which has significant impact on the Cosmetics Regulation. In line with the strategy’s objectives, the Cosmetics Regulation is likely to place bans on new hazard categories, extend the “Generic Approach to Risk Management”, improve the efficiency and coherence of safety assessments, take into consideration of chemicals’ combined effects in the risk assessment, consolidate the management of specific substances, and include digital labelling as a feasible labelling option.

On December 29, 2022, China NMPA released the finalized Regulations on Supervision and Administration of Enterprises in Implementing Entity Responsibility for Cosmetic Quality and Safety, which specifies the responsibility entities of cosmetic’s quality and safety, emphasizes the responsibilities of key positions related to cosmetic quality and safety, as well as clarifies the scope of personnel subject to penalties when certain misconduct happens, and the situations where penalties can be mitigated or exempted.

EU Safety Gate Alerts 212 Batches of Non-compliant Cosmetics in 2022

In 2022, EU Safety Gate published 212 alerts on non-compliant cosmetics notified by 16 countries, among which Sweden, Lithuania, Italy, Germany and France ranked the Top 5. In terms of product category, perfume tops the list of non-compliant cosmetics, followed by skin-lightening cream/lotion, body cream/lotion, face cream and hair dye. For the notified cosmetics, the detection of prohibited ingredient is the primary non-compliance reason. Other major reasons include failing to meet the use condition, risk of being contaminated, excessive concentration of heavy metal and unqualified labelling.
