Indonesia to Enhance Law Enforcement on Imported Cosmetics

Indonesia POM disclosed that in 2016 they found 9071 types of illegal imported cosmetics with a total value of more than 77.9 billion IDR. The illegal cosmetics included cosmetics containing hazardous ingredients, cosmetics without a notification number and cosmetics imported through illegal channels. The discovered hazardous ingredients contained in the cosmetics include mercury, hydroquinone, retinoic acid, red dye K3, K10 red, Sudan IV and even two pharmaceutical drugs: Clindamycin ( an antibiotic which inhibits the bacterial 50s ribosomal subunit) and Theophylline (a drug used to treat asthma) both which have significant side effects...

India Encourages Use of Non-animal Alternative Tests

Recently India Ministry of Health & Family Welfare published the notice regarding partial amendment to “Drugs and Cosmetics Rules, 1945”. The amendments are relating to animal toxicity studies and encourage the use of OECD (Organisation for Economic Cooperation and Development) validated non-animal alternatives.

China Details Cosmetic License Renewal Requirements

China Food and Drug Administration released the amended provisions for renewal of cosmetic license for public consultation. The consultation period will end on Dec 31. In the past, there was only one clause in the Provisions for Application and Acceptance of Administrative Licensing for Cosmetics regulating the renewal of cosmetic license which stipulated that “Applicants intending to extend the validity must apply 4 months prior to the expiry date”. The new provisions adjust the deadline to apply for renewal and detail the application procedures and requirements. New Provisions 1. Korea to Fine Manufacturers and Importers of Animal-tested Cosmetics

Recently Korea MFDS announced that it will impose a fine of 1 million Korean won on manufacturers and importers of cosmetics that are tested on animals or contain animal-tested ingredients after the implementation of the animal testing ban.

China Cosmetic Production License Deadline Drawing Close

Take home: Domestic Manufacturers shall exchange or obtain a Cosmetic Production License before Dec 31 2016. On Dec 15 2015 CFDA announced the consolidation of the cosmetic licensing system. Domestic manufacturers will no longer need to obtain a Cosmetics Production License from AQSIQ and a Hygiene License for Production Enterprise of Cosmetics from provincial FDAs and will now only need a Cosmetic Production License from provincial FDAs (see CL news).

Avoiding China Cosmetic Animal Testing Requirements: Tips for Industry

Takehome: To avoid animal testing requirements international cosmetics companies can consider: 1) Setting up a manufacturing facility in China to manufacture non-special use cosmetics 2) Consider using CBEC, although the regulatory landscape in this sector is changing fast. In the next couple of years we can expect standard regulatory requirements to be the same as crossborder ecommerce. 3) Consider exporting raw materials or semi-finished products in bulk for repackaging in China. 4) There is some light at the end of the tunnel for cruelty free cosmetic companies as China recently approved an alternative to animal testing (see CL news).

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
