Korea to Amend Functional Cosmetics Testing Regulation
Jan 28, 2015
South Korea’s Ministry of Food and Drug Safety (MFDS) has announced that it is to amend the “Standards and Testing Methods of Functional Cosmetics”. The regulation will include 8 new kinds of functional cosmetic preparations containing whitening ingredients and whitening/wrinkle-relieving compounds with validated safety and efficacy. Under the new system the review process will be replaced with a mandatory requirement to submit supporting reports.

Korea Implements Amendments to Three Major Cosmetic Regulations

Korea’s Ministry of Food and Drug Safety (MFDS) recently implemented a series of amendments to three major regulations, namely “Requirements for Exemption from Quality Inspection of Imported cosmetics”, “Standards for Manufacture and Quality Control of Excellent Cosmetics” and “Enforcement Rules of the Cosmetic Act”. All manufacturers and importers in Korea are required to comply with these new amendments.

South Korea to End Animal Testing on Finished Cosmetics

KFDA announced its intent to eliminate animal testing for finished products and in the coming months will make provisions about the permitted alternatives to animal testing along with more specific implementation procedures. In the interim the KFDA will further consider instituting a ban on animal testing of cosmetics ingredients.

Korean Cosmetic Regulation: Korea Excellent Cosmetics Standards

The regulatory stipulations on recycling and manufacture of hazardous cosmetics in Korea as outlined in the “Standards of Manufacture and Quality Control for excellent cosmetics” do not conform to requirements as outlined in the newly revised Cosmetic Act. To avoid any confusion MSDF decided to amend the standard in order to align it with the Cosmetic Act.

Korea Cosmetic Regulation: Deadline of Submitting the Actual Production and Import Reports to Be Extended

On August 29 2014, MDSF announced by an administrative forenotice that the duration of submitting the actual production reports for cosmetics would be extended in order to resolve some problems existing in the implement of the rule “Regulations on the actual production and import reports for cosmetics and the inventory of cosmetic ingredients”, and improve the accuracy of the documents as well.

On July 29 2014, Korea’s Ministry of Food and Drug Safety (MFDS) issued a pre-announcement on the partial amendment to “Provisions on Security Standard for Cosmetics” which when implemented will standardize the content of cosmetic ingredients and increase the requirements of risk assessment for partial fungicide and preservative ingredients. The announcement is open for public consultation until September 26 2014.

Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
