Registering a Trademark in Thailand: A Guide for Foreign Investors

Trademarks, certification marks, collective marks, and service marks in Thailand are protected by the Trademark Act (No.3) B.E.2559 (2017). Trademarks are registered with the Department of Intellectual Property and non-residents can only register by appointing a Thai resident by granting them the power of attorney. Thailand’s new fast-track system for trademark renewals will ensure that the examination of applications and granting of the certificate of renewal only takes 45 minutes.

Thai Consumer Preferences: Skin Care and Cosmetics

A recent HKTDC Research study found that 81% of the Thai consumers surveyed planned to spend more or about the same as they do now on skin care and cosmetics in the next three years. The affluent Thai middle class has an insatiable appetite for fresh new beauty products. The study also discovered a few trends in Thailand’s beauty and personal care products market. The growth of the market is being driven by the ubiquitous social media usage, bringing a whole host of new opportunities and challenges with it. The most obvious change is that social media has provided a new way to target more refined target segments of consumers. Focus group respondents indicated that they usually discover new brands or products via social media, and are more likely to give products a try if user reviews are positive.

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
China’s Safety and Technical Standards for Cosmetics (STSC) and Its Updates
The current cosmetic technical standard STSC 2015 specifies the cosmetics' general safety standards, prohibited/restricted/permitted ingredients and testing methods. It is revised aperiodically in response to changing trade practices in the industry. China is planning to issue a new version of STSC.
