[Updated] EU to Amend Cosmetic Ingredient Use Requirements: 14 Newly Prohibited Ingredients and 2 Newly Restricted Ingredients

The EU introduced amendments to the Annexes of Regulation (EC) No 1223/2009 on Cosmetic Products respectively on February 1, 2022 and February 3, 2022. The amendments including: - Adding 14 prohibited ingredients - Deleting 1 prohibited ingredient - Adding 2 restricted ingredients - Amending 1 permitted preservative

EU to Impose Strict Restrictions on Synthetic Microplastics in Cosmetics

On September 5, 2022, the EU launched a two-month consultation on a draft regulation on the restrictions upon synthetic microplastics. Transitional periods ranging from 4-12 years are proposed for cosmetics subject to this draft regulation.

EU RAPEX Receives 72 Alerts for Non-compliant Cosmetics in 2022 H1, Detection of Prohibited Ingredient Being the Primary Reason

From January to June 2022, RAPEX received 72 alerts on measures taken against non-compliant cosmetics. These cosmetics were notified by 14 countries, among which Sweden, Ireland, Lithuania, Germany and France ranked the Top 5. Besides, the detection of prohibited ingredient is the primary non-compliance reason for the notified cosmetics,

EU Lowers the Labelling Threshold for Formaldehyde Releasers in Cosmetics Regulation

On July 11, 2022, the EU announced to amend the labelling requirement for formaldehyde releasers in the preservatives list to Regulation (EC) No 1223/2009. The new amendment shall enter into force on July 31, 2022. Subject to it, the present labelling threshold of 0.05% (500 ppm) will be reduced to 0.001% (10 ppm).

EU Amends the Use Requirements for 2 UV Filters in Cosmetics Regulation

On July 7, 2022, the EU updated the use requirements for two UV filters in Regulation (EC) No 1223/2009 (Cosmetics Regulation), Benzophenone-3 (CAS no 131-57-7) and Octocrylene (CAS no 6197-30-4). The new amendments shall enter into force on July 28, 2022.

How Are Endocrine Disruptors Regulated by EU Cosmetics Regulation?

Endocrine disruptors are chemical substances that alter the functioning of the endocrine system and negatively affect the health of humans and animals. Under EU Cosmetics Regulation, suspected endocrine disruptors will be banned or restricted on a case-by-case basis following their safety assessment result by Scientific Committee on Consumer Safety (SCCS). In early 2019, a priority list of 28 potential endocrine disruptors in cosmetics was compiled, among which the SCCS released opinions for 12 so far.

EU SCCS Releases Final Opinion on Kojic Acid

In November 2021, EU Scientific Committee on Consumer Safety (SCCS) released a preliminary opinion on Kojic Acid (CAS No. 501-30-4, EC No. 207-922-4), which was subject to a commenting period from November 5, 2021 to January 14, 2022. Considering the comments received during this period, the SCCS released a final opinion on Kojic Acid on March 17, 2022.

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
