On December 16, 2024, Brazil published the Resolution RDC No. 949/2024 in its Official Gazette, amending Resolution RDC No. 907/2024 with primary updates to the classification of personal hygiene products, cosmetics, and perfumes.1 These changes were originally scheduled to take effect on March 3, 2025. However, on February 28, 2025, Brazil issued Resolution No. 966/2025, postponing the enforcement date of the changes to April 7, 2025.2
Enacted in September 2024, Resolution RDC No. 907/2024 established rules on the definition, classification, labelling, packaging, microbiological control, and regularization procedures of personal hygiene products, cosmetics, and perfumes. With MERCOSUR/GMC/Res. No. 07/05 as reference for product classification, it categorized products into Grade 1 and Grade 2 based on the product's formulation and intended purpose, the likelihood of adverse effects from improper use, etc. As MERCOSUR/GMC/Res. No. 07/05 had been repealed by MERCOSUR/GMC/Res. No. 18/23 in July 2023, Resolution RDC No. 949/2024 is issued to update the reference document and associated rules.
With the enforcement of Resolution RDC No. 949/2024 on April 7, 2025, the classification of personal hygiene products, cosmetics, and perfumes in Brazil will follow the framework outlined in the table below. For products already registered or notified with the Brazilian Health Regulatory Agency (Anvisa) before the effective date, they shall be compliant with the updated classification rules by January 2, 2030.
