Brazil Introduces Updates to Prohibited and Restricted Ingredient Lists

On December 31, 2024, Brazil launched two separate public consultations to review draft amendments to the lists of prohibited and restricted ingredients. Public input is accepted from January 7 to March 7, 2025.1-2

1. List of Prohibited Ingredients

Currently, cosmetics intended for the Brazilian market shall not contain ingredients listed in the annex to Resolution RDC No. 529/2021. The draft outlines 13 additions, 2 revisions, and 5 deletions to this annex.

1. Cosmetics that have been registered or notified with the Brazilian Health Regulatory Agency (Anvisa) prior to the publication of the final regulation will be provided a 12-month transitional period to comply with the updated prohibited ingredients list.

2. List of Restricted Ingredients

The annex to Resolution RDC No. 530/2021 compiles 132 ingredients permitted for use in cosmetics under specific conditions. This includes 26 fragrance allergens, which shall be indicated by their INCI names on product labels if their concentration exceeds 0.001% in leave-on products or 0.01% in rinse-off products. The draft introduces 115 new ingredients, removes 7, and makes comprehensive revisions to existing entries by adding INCI names and CAS numbers, and updating use conditions to reflect the latest scientific research. As a result, the updated restricted ingredients list will contain 246 ingredients in total, with the number of regulated fragrance allergens increasing to 77.

- 0.001% in leave-on products
- 0.01% in rinse-off products.

Notes:
1. Cosmetics that have been registered or notified with Anvisa prior to the publication of the final regulation will be provided a 24-month transitional period to comply with the updated restricted ingredients list.
2. Following the publication of the final regulation, cosmetics containing new fragrance allergens will be provided a 36-month transitional period to fulfill the individual labeling requirements for fragrance allergens.
