On Feb. 21st, 2022, eight departments (including Ministry of Finance, National Development and Reform Commission, Ministry of Industry and Information Technology, Ministry of Ecological Environment, Ministry of Agriculture and Rural Affairs, Ministry of Commerce, General Administration of Customs, and Endangered Species Import and Export Management Office of PRC) jointly announced to optimize the List of Import Goods through Cross-border E-commerce. The new list will be effective starting from Mar. 1st, 2022.
Compared with the current 2019 version, the optimization lies in the following aspects:
1. Add 29 items into the positive list
The competent authorities newly include 29 popular items into the positive list based on the increasing consumption demand of the products such as tomato juice, crocus, other scallop, etc. It is noteworthy that crocus and other scallop can only be imported through bonded warehouse mode.
2. Adjust the tariff code based on the recent adjustment of tariff rules
The new list adds the HS codes of 115 items, among which 41 are food products, including frozen scallop, birds’ nest, olive oil, etc. In addition, HS codes of 80 items are abolished.
3. Adjust the remarks of 206 items
Among the 206 items whose remarks are revised, 11 of them belong to cosmetic products. For 5 of which, the 2019 version stipulates that they cannot be imported through CBEC if they are listed in the Wild Fauna and Flora Import/Export Commodity Catalogue. Apart from this requirement, the new positive list adds that the enterprise should also provide certificate issued by the Endangered Species Import and Export Management Office of PRC, proving that their products do not belong to Wild Fauna and Flora Import/Export Commodity Catalogue. For the remaining categories that had no remarks before, a remark has been added, requiring that they cannot be imported through CBEC if they are included in the Catalogue of Commodities Prohibited from Import (Seventh Batch).

4. Remove one item from the positive list
The new list canceled the item “other sword, scimitar, bayonet, spear and similar weapon and their components; other scabbard and sword scabbard”.

Industry Comments
In the import and export trade, it is a common occurrence for cosmetic commodities to be punished by the Chinese customs because their ingredients involve endangered species and the relevant species certificates are not provided as required. Therefore, it is necessary for cosmetics companies to check whether the product ingredients involve endangered species before import to ensure compliance.
At present, China adopts the List of National Key Protected Wild Plants in China and the Wild Fauna and Flora Import/Export Commodity Catalogue as the supervision standards. If the imported goods contain the ingredients of endangered species, the enterprise should notify it before the declaration and present the relevant wild fauna and flora import permitting certificate or the species certificate for species not included in the Wild Fauna and Flora Import/Export Commodity Catalogue. Otherwise, they may be subject to a fine of more than 5% and less than 30% of the value of the goods.
In practice, cosmetics imported by general trade can apply for the above-mentioned certificates for each batch of products to ensure normal customs entry. Products imported through CBEC trade channel will be rejected and cannot be sold in the Chinese market as long as they involve endangered species.
The adjustment of the CBEC positive list this time has reduced the restrictions on CBEC-traded transactions, which grants the same treatment to CBEC imported cosmetics and general trade imported products in terms of endangered species management.
