U.S. FDA Sets November 2026 Timeline for Formaldehyde Ban and Fragrance Allergen Rule

On July 3, 2026, the Office of Information and Regulatory Affairs (OIRA) released the 2026 Regulatory Plan and the Unified Agenda of Federal Regulatory and Deregulatory Actions, updating the U.S. Food and Drug Administration (FDA)'s regulatory timeline for cosmetics.

According to the agenda, the FDA plans to issue a Notice of Proposed Rulemaking (NPRM) in November 2026 for Use of Formaldehyde and Formaldehyde-Releasing Chemicals as an Ingredient in Hair Smoothing Products or Hair Straightening Products. The proposal would prohibit the use of formaldehyde and formaldehyde-releasing chemicals, such as methylene glycol, in hair smoothing and hair straightening products that are applied to the hair and heated under their intended conditions of use.

The FDA also expects to publish an NPRM in November 2026 for Disclosure of Fragrance Allergens in Cosmetic Labeling, implementing the fragrance allergen labeling provisions introduced under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). The proposed rule would identify substances that must be disclosed as fragrance allergens on cosmetic product labels.

Compared with the Spring 2025 Unified Agenda, the proposed rule on Testing Methods for Detecting and Identifying Asbestos in Talc-Containing Cosmetic Products is no longer included, following the FDA's withdrawal of the rulemaking in late 2025. In addition, the long-awaited Good Manufacturing Practice (GMP) rule required under MoCRA does not appear in the current agenda, indicating that its rulemaking timeline remains uncertain.
