On Nov. 8, 2021, the Governor of New Jersey State signed a bill (S1726) prohibiting the sales of cosmetic products that have been tested on animals. 1 The bill will take effect on Mar. 1, 2022. It does not apply to cosmetics tested on animals before Mar. 1, 2022.
According to the bill, no manufacturer shall sell or offer for sale in New Jersey any cosmetic that was developed or manufactured using an animal test, if the test was conducted or contracted on or after Mar. 1, 2022. Any violators will be subject to a penalty of up to 1,000 USD.
Four Exceptions of Animal Testing Ban
Notably, the animal testing ban does not apply to the following situations:
1) The animal testing is required by a federal or State regulatory authority and
The ingredient that requires animal testing is in wide use and there is no substitute; and
The ingredient is associated with a human health problem, and there is a research protocol to prove that animal testing is necessary; and
There is no non-animal test method or strategy accepted by a federal or State regulatory authority.
2) The animal testing is conducted outside of the US to comply with foreign regulations, and the safety of such cosmetics can be independently verified using non-animal tests.
3) The animal testing is conducted on a product or ingredient subject to the requirements of chapter V of the federal Food, Drug, and Cosmetic Act.
4) The animal testing is conducted for non-cosmetic purposes required by a federal, State, or foreign regulatory authority.

Eight states in the US have passed bans on animal testing of cosmetics. If companies wish to sell in those states, they must already adopt non-animal test methods for their products and ingredients.
