New Zealand Releases Updated Cosmetic Products Group Standard

On 24 February 2023, New Zealand's Environmental Protection Authority (EPA) formally received the application under section 96B of the Hazardous Substances and New Organisms Act 1996 to amend the Cosmetic Products Group Standard 2020 (Group Standard). Following a nearly year-long period, the amendments to the Group Standard were approved by New Zealand in January 2024.

The key amendments that have been adopted include:

Expand the applicable scope

  • Require non-hazardous cosmetic products that include a hazardous component (or ingredient) to comply with the Group Standard

  • Cover non-hazardous aerosol cosmetic products that contain a hazardous component

Phase out PFAS  (perfluoroalkyl and polyfluoroalkyl substances)

  • Import and manufacture cosmetic products containing PFAS until 31 December 2026

  • Supply cosmetic products containing PFAS until 31 December 2027

  • Dispose all cosmetic products containing PFAS by 30 June 2028

Update ingredient lists in line with the EU cosmetic regulation (with one exemption for zinc pyrithione)

Increase nanomaterial record-keeping requirements

  • Any person intending to import into, or manufacture in, New Zealand a cosmetic product containing nanomaterials, must at the time they first import or manufacture the substance, notify the Authority in writing of -

      a) the name of the substance; and

      b) the HSNO approval number and/or title of the Group Standard under which the substance has a deemed approval; and 

      c) the nature of the nanomaterials the substance contains.

  • The requirement does not apply to nanomaterials used as colourants, preservatives, or UV filters regulated under the scope of Group Standard.

Align with international best practice for alternative compliance

  • Update the reference to the International Fragrance Association (IFRA) Standards from the 39th amendment to the 50th amendment

  • Amend clauses and conditions for label exemptions, included the 24-hour contact label exemption, add the United Kingdom (UK) to the alternative international regulators list, and update the outdated Australian Government Therapeutic Goods Order (TGO) reference

Others

  • Improved the format, presentation, and searchability of the Group Standard

  • Corrected minor grammatical and punctuation errors

With the exception of the implementation requirements for PFAS, the remaining amendements will come into effect at various times:

  • After December 31, 2025, cosmetic products that comply with the Pre-Amendment scope and conditions are not allowed to be imported and manufactured.

  • After December 31, 2026, cosmetic products that comply with the Pre-Amendment scope and conditions are not allowed to be supplied.

  • By June 30, 2027, all cosmetic products that do not meet the Post-Amendment scope and conditions must be properly disposed of.
