EPA released the draft new edition of "Cosmetic Product Group Standard" (not for public consultation) which stipulates the scope and definition of cosmetics in this group:

This group standard applies to any substance imported or manufactured for use as a cosmetic product, where that cosmetic product is classified as hazardous according to the hazard classification criteria as set out in the Hazardous Substances (Classification) Notice 2017(more information see database Cosmetic Products Group Standard 2017 - HSR002552);

Exceptions/Exclusions:

  1. Any product containing: asbestos or a persistent organic pollutant or a chemical which exhibits the characteristics of a persistent organic pollutant;
  2. Any product containing the ingredient listed on "Components Cosmetic Products Must Not Contain";
  3. Any product which uses the ingredient listed on "Components Cosmetic Products Must Not Contain Except Subject To The Restrictions And Conditions Laid Down", "Colouring Agents Cosmetic Products May Contain With Restrictions", "Preservatives Cosmetic Products May Contain With Restrictions", or "UV Filters Cosmetic Products May Contain With Restrictions" but not comply with the conditions and restrictions;
  4. Any product containing a component banned by the International Fragrance Association as set out in the IFRA Code of Practice;
  5. Any product intended to be ingested, inhaled, injected or implanted into the human body.

The manufacturer/ importer can assign the cosmetic to this group, but should comply with the following rules:

  1. ensure that the substance complies with clause 4 of this Group Standard (Scope of Group Standard); and
  2. keep a record of how it was determined the substance complies with clause 4 of this Group Standard.
  3. ensure that the record contains sufficient information to allow for independent verification that the substance complies with clause 4 of this Group Standard (Scope of Group Standard); and
  4. have that record available for inspection.

Once the manufacturer/importer assigns a cosmetic to "Cosmetic Product Group Standard", it should comply with the labeling, safety data sheet and packaging requirements specifically for this group for 4 years (more information see database Cosmetic Products Group Standard 2017 - HSR002552).
