On January 17, 2025, the Vietnam Minister of Industry and Trade (MOIT) issued a notice regarding the development of an E-Commerce Law aimed at enhancing the regulation and management of commercial activities conducted on e-commerce platforms, including the cosmetic trade.
This notice introduced a series of supporting documents, including the proposal to develop the E-Commerce Law, the draft detailed outline of the law, a summary report on the enforcement of existing laws, and an assessment report on the policy impact to develop the E-Commerce Law.
Regulatory Background
The existing legal framework for e-commerce has established a foundation for regulating business activities in Vietnam’s digital market. However, challenges remain, such as the rapid evolution of new business models (such as live-streaming sales), difficulties in controlling cross-border e-commerce activities, and limited awareness among consumers and businesses. The MOIT consistently reviews and amends the implementation of existing laws to improve the legal framework for e-commerce moving forward.
The Proposed E-Commerce Law
The Draft Detailed Outline of the E-Commerce Law is structured into eight chapters, which are as follows:

Chapter III: E-Commerce Activities
Chapter IV: E-Commerce Support Services
Chapter V: E-Contract Certification in Commerce

Chapter VII: Dispute Resolution, Inspection, and Handling of Violations
Chapter VIII: Enforcement Provisions
