Vietnam Requires Legal Representation for E-commerce Platforms

The draft E-Commerce Law requires foreign e-commerce platforms operating in Vietnam—including those using a .vn domain, offering Vietnamese-language content, or recording over 100,000 transactions annually—to appoint a local legal representative or establish a legal entity in the country. This representative will be held accountable for violations committed by the platform.

On January 17, 2025, the Vietnam Ministry of Industry and Trade (MOIT) issued a notice announcing the development of an E-Commerce Law, accompanied by a detailed outline of its provisions. More recently, the MOIT released a draft of the law, which introduces stricter regulations specifically targeting e-commerce platforms. This legislation, expected to be effective in 2026, aims to address regulatory gaps, strengthen consumer protection, and promote the sustainable growth of Vietnam’s digital economy.
