Ensuring cosmetic product safety requires careful control of ingredients. To achieve this, the UK Regulation (EC) No 1223/2009 (Cosmetics Regulation) sets out annexes governing cosmetic ingredients as follows:
1) Annex II: List of Substances Prohibited in Cosmetic Products;
3) Annex IV: List of Colorants Allowed in Cosmetic Products;
4) Annex V: List of Preservatives Allowed in Cosmetic Products;
5) Annex VI: List of UV Filters Allowed in Cosmetic Products.
Yes. Any new ingredient intended for use as a colorant, UV filter, or preservative that is not listed in Annex IV, V, or VI must be supported by a safety dossier, submitted to the Office for Product Safety and Standards (OPSS) via [email protected] for safety assessment. This requirement also applies to nanomaterials.
The UK Cosmetics Regulation generally prohibits the use of CMRs in cosmetic products. However, exemptions can be requested by industry for category 2 CMRs, which will be evaluated by a scientific advisory group. If deemed safe, their use can be permitted. For category 1A and 1B CMRs, assessment by the scientific advisory group is only possible if the conditions set out in Article 15 of the Cosmetics Regulation are met.
When the use of a cosmetic ingredient presents a potential risk to human health, the Secretary of State (SoS) will request an opinion from the Scientific Advisory Group on Chemical Safety of Non-Food and Non-Medicinal Consumer Products (SAG-CS). Following consultation with the SAG-CS, the SoS will, where necessary, amend Annexes II to VI accordingly.
