On September 20, 2024, EU released the Commission Regulation (EU) 2024/2462, finalizing the prohibition on the use of Undecafluorohexanoic Acid (PFHxA), its salts, and related substances in various applications, including cosmetics. As per the regulation, effective October 10, 2026, the use of PFHxA, its salts, and related substances will be prohibited in cosmetics.

EU Safety Gate Flags 521 Batches of Non-compliant Cosmetics in H1 2024, with 484 Batches Containing BMHCA

In H1 2024, EU Safety Gate circulated alerts on 521 batches of non-compliant cosmetics. Most non-compliant cosmetics were originated from Italy, Germany, and France. In terms of product category, perfume tops the list of non-compliant cosmetics, followed by eau de toilette, shampoo, shower gel, and hair dye. The non-compliance reasons for the reported cosmetics include detection of prohibited ingredient, failure to meet the use condition, risk of being contaminated, unqualified labelling, and excessive concentration of heavy metal.

On July 1, 2024, TFDA approved the immediate repeal of four regulations on specific purpose cosmetics, to align with the cancellation of specific purpose cosmetics category. The repealed regulations include Regulations for Issuance of Permit License of Specific Purpose Cosmetics, Regulation for Authorizing the Applications of Import of Non-licensed Specific Purpose Cosmetics, Import Limits for Personal Use Specific Purpose Cosmetics Exempted from Inspection and Registration, and Particulars of Specific Purpose Cosmetics that May Be Voluntarily Modified.

On June 24, 2024, EU notified WTO of a draft proposing amendments to the prohibited and restricted ingredients lists of Regulation (EC) No 1223/2009 in response to newly classified CMR substances in Commission Delegated Regulation (EU) 2024/197. The draft is currently open for comments until August 23, 2024, and scheduled to take effect on September 1, 2025.

On May 30, 2024, TFDA finalized its plan to adjust the current cosmetic ingredient lists, which will take effect on July 1, 2024. The adopted amendments mainly include abolishing the current List of Specific Purpose Ingredients in Cosmetic Products, and the List of Antibacterial Ingredients Allowed in Cosmetic Products, newly establishing the List of UV Filters in Cosmetic Products, as well as adding 122 ingredients to, revising 31 ingredients in, and deleting 2 ingredients from the List of Ingredients Restricted in Cosmetic Products.
