China Cosmetics Regulation: New Measures on Cosmetic Labelling

On November 15 2014, China Food and Drug Administration officially published the draft Administrative Measures on Cosmetics Labelling for public comment. Most provisions in the new draft evolve from the previous regulations concerning labelling, namely Administrative Provisions on Cosmetics Labelling, GB 5296.3 - 2008 and Guide to the Naming of Cosmetics. Once effective, the new draft will replace the Existing 100 Order and “Guide to the Naming of Cosmetics” as the main basis of law-enforcement in the administration of cosmetics labelling. The provisions in the GB 5296.3 – 2008 that do not conflict with the new draft will continue to be applicable.

CFDA Consults on Draft Regulations concerning the Supervision and Administration of Cosmetics

In the second half of 2013, CFDA began reforms of Regulations concerning the Hygiene Supervision over Cosmetics in order to further standardize the production and operation of cosmetics, reinforce the supervision and administration of cosmetics, ensure the quality of cosmetics and safety and safeguard consumers’ health. On November 8 2014, CFDA started to solicit public opinion on the revised version, renamed Regulations concerning the Supervision and Administration over Cosmetics. The regulation gives clear provisions for filing or registration of cosmetic ingredients and products, production of cosmetics, labeling and advertisement as well as supervision over cosmetics throughout the supply chain. Once this regulation comes into effect, the Regulations concerning the Hygiene Supervision over Cosmetics shall be repealed simultaneously.

Korea Cosmetic Regulations: Korea Cosmetic Ingredients Standards

On July 29 2014, Korea’s Ministry of Food and Drug Safety (MFDS) issued a pre-announcement on the partial amendment to “Provisions on Security Standard for Cosmetics” which when implemented will standardize the content of cosmetic ingredients and increase the requirements of risk assessment for partial fungicide and preservative ingredients. The announcement is open for public consultation until September 26 2014.

CIQs Continue to Review Labels of Cosmetic Products

The issuance of Decree No 638 by the state council on July 27th has caused considerable confusion as to whether or not imported cosmetic products are still subject to label review by CIQs. Decree No 638 effectively abolished the article 34 of Decree No.477, which stated that “before import and export of food and cosmetics, CIQs will review the label and issue a certificate for label review”.
