EU to Ban the Use of 5 Batches of Nanomaterials in Cosmetics

The EU released a Draft Commission Regulation to include 5 batches of nanomaterials into the prohibited ingredients list of Regulation (EC) No 1223/2009. The final date for comments about this draft is April 12, 2022.

On February 11, 2022, the EU updated a new draft of Commission Regulation to enforce the prohibition on nanomaterials in cosmetic products. The new draft proposed to include 5 batches of nanomaterials into the prohibited ingredients list of the Regulation (EC) No 1223/2009, and is open for comments until April 12, 2022. 1 The 5 batches of nanomaterials are:

Reason for Amendment

Nanomaterial has been an important focus of attention in EU legislation. According to the Regulation (EC) No 1223/2009, a high level of protection of human health shall be ensured for products containing nanomaterials. If the European Commission has concerns regarding the safety of a nanomaterial, the Commission shall request the Scientific Committee on Consumer Safety (SCCS) to give its opinion on the safety of it. 

The SCCS has performed safety assessments on the above-mentioned nanomaterials, and concluded that there is a basis of concern that they can pose a health risk to the consumers. As a response to SCCS’s opinion, the new draft is therefore released to amend the Regulation (EC) No 1223/2009 accordingly.
