On September 25, 2018, Taiwan FDA sent a draft of Requirements for Cosmetic Packaging, Container, Labeling and Instruction to Importers and Exporters Association of Taipei for their opinions.

The draft specifies the format, method and other compliance matters of cosmetic packaging, containers, labels and instructions, clearly stipulates mandatory labeling items on the outer packaging and the container, modifies the font size of the labels and add some new terms.

Items should be labeled on cosmetic outer packages and containers after amendments:

Product name (it shall be conspicuously labeled on both outer package and container)

Usages

Applications and storage method

Net weight, capacity of content or quantity

Full ingredients (special-use cosmetics should label the content of special-use ingredients)

Precautions

Name, address, phone number of manufacturer or importer; Origin of imported cosmetics

Date of manufacture and validity period or storage life, or validity period and storage life

Batch number

Other items that announced by the central competent authority

New provisions

Article 4

The ingredients should be ranked according to their concentration (w/w or w/v) from high to low. If the concentration of the ingredient is less than or equal to 1%, it may be arbitrarily arranged after the ingredients whose content is more than 1%.

Article 5

The colorants’ names should refer to US Food and Drug Administration's Color Index and EC Directive Annex IV nomenclature. Flavor and fragrance need to be marked with “香精”, “香料”, “Flavor” or “Fragrance”.

Article 6

For the colorants added or possibly added to makeup products, common colorants may be listed first and then add the notes such as "+-" or "may contain" or "可能加入色素".

Article 7

Ingredients under following conditions are exempt from labeling:

  1. Impurities in the ingredients;
  2. Ingredients added during manufacture but not present in the final product;
  3. Ingredients brought in by the use of permitted ingredients, not directly added, the content is lower than the limit standard, and has no function for the final product.

Article 9

If the imported cosmetics are subpackaged or repackaged in Taiwan, the outer packaging or container shall label the name and address of subpackaging or repackaging enterprises.
