Vietnam is Amending Advertising Law, Banning Misrepresentation of Cosmetics as Pharmaceuticals

On February 26, 2024, the Vietnam Chamber of Commerce and Industry (VCCI) unveiled the draft of revisions and supplements to the Advertising Law. Prepared by the Ministry of Culture, Sports, and Tourism (MOCST), the draft includes three new requirements specifically for cosmetics advertising:

  1. Advertisements must include the following information: the name of the cosmetic product, its characteristics and uses, the name and address of the organization or individual responsible for marketing the product, and any warnings mandated by international agreements.

  2. It is prohibited to misrepresent cosmetic products as pharmaceuticals in advertisements.

  3. Cosmetic advertisements in audiovisual and print media must explicitly state the name of the cosmetic product, its characteristics and uses, and any warnings specified by international agreements.
