Background
The current regulatory framework for cosmetics in Vietnam is primarily based on the ASEAN Cosmetic Directive (ACD) and Circular 06/2011/TT-BYT Providing Cosmetic Management, which governs the production, labeling, advertising, import/export, and inspection of cosmetic products. However, challenges remain, including unclear definitions of cosmetic use and purpose, inefficient post-market surveillance, lack of periodic inspections, and increasing difficulties in regulating online cosmetic sales. Additionally, Decree 93/2016/NĐ-CP Conditions for Manufacture of Cosmetic Products also reveals regulatory gaps in requirements for cosmetic production conditions, quality control systems, inspection checklists, etc.
To address these shortcomings, the draft decree aims to streamline administrative procedures, strengthen regulatory effectiveness and enforcement, and establish a transparent, safe, and internationally harmonized business environment.
Overview of Draft Decree on Cosmetic Management
The draft decree comprises 10 chapters and 68 articles, outlining comprehensive provisions across various aspects of cosmetic management. The brief contents are presented in the table below.
