Vietnam Publishes Draft Decree on Cosmetic Management

On May 15, 2025, the Ministry of Health of Vietnam issued a draft decree aimed at modernizing cosmetics regulations and strengthening oversight of the cosmetics industry.

On May 15, 2025, the Vietnam Ministry of Health (MoH) issued a Draft Decree on Cosmetic Management, accompanied by a series of supporting documents, and invited stakeholders to provide their feedback. The released documents include:

Background

The current regulatory framework for cosmetics in Vietnam is primarily based on the ASEAN Cosmetic Directive (ACD) and Circular 06/2011/TT-BYT Providing Cosmetic Management, which governs the production, labeling, advertising, import/export, and inspection of cosmetic products. However, challenges remain, including unclear definitions of cosmetic use and purpose, inefficient post-market surveillance, lack of periodic inspections, and increasing difficulties in regulating online cosmetic sales. Additionally, Decree 93/2016/NĐ-CP Conditions for Manufacture of Cosmetic Products also reveals regulatory gaps in requirements for cosmetic production conditions, quality control systems, inspection checklists, etc.

To address these shortcomings, the draft decree aims to streamline administrative procedures, strengthen regulatory effectiveness and enforcement, and establish a transparent, safe, and internationally harmonized business environment.

Overview of Draft Decree on Cosmetic Management

The draft decree comprises 10 chapters and 68 articles, outlining comprehensive provisions across various aspects of cosmetic management. The brief contents are presented in the table below.

Chapter II Classification and Grouping of Cosmetic Products

Classification of cosmetic products based on formulation ingredients, intended use, and route of application as well as the procedure for classifying and grouping cosmetic products.

Chapter III Cosmetic Product Notification

This chapter stipulates the cosmetic notification requirements, including conditions for cosmetic notification, cosmetic notification dossier, procedures for notifying cosmetics, procedures for changing and supplementing the cosmetic notification form, etc. The cosmetic product notification is valid for three years from the date of notification.

Chapter IV Cosmetic Production

This chapter outlines conditions for obtaining a Certificate of eligibility for cosmetic manufacturing and ASEAN Guidelines for Cosmetic Good Manufacturing Practices (CGMP-ASEAN), as well as their revocation procedures.

Chapter V Cosmetic Export and Import

This chapter provides regulations on the export and import of cosmetics, including Free Sale Certificates (CFS) for domestically manufactured cosmetics intended for export and for imported products.

Chapter VI Product Information File, Advertising, and Labeling of Cosmetics

This chapter mandates:

  • Cosmetic circulated in the market must have a Product Information File (PIF) per ASEAN guidelines;

  • Advertising content for cosmetics that does not require confirmation from competent authorities;

  • Unacceptable claims and terminology in cosmetic advertising;

  • Regulations on advertising and labeling of cosmetics.

Chapter VII Cosmetic Sampling Quality Inspection

This chapter outlines:

  • Principles and authority for cosmetic sampling;

  • Responsibilities and rights of sampling personnel;

  • Conclusion of cosmetic samples quality testing.

Chapter VIII Recall, Suspension, Destruction of Cosmetic Products, Temporary Suspension of Receiving Cosmetic Notification Dossiers, and Handling of Non-Compliant Cosmetics

This chapter regulates:

  • Cases requiring suspension, recall, or destruction of cosmetic products;

  • Revocation of product notification and suspension of accepting new notifications;

  • Forms, authority, and responsibilities related to cosmetic product recalls.

Chapter IX Implementation Organization

This chapter specifies the responsibilities of relevant ministries, agencies, organizations, and individuals involved in the production and trade of cosmetic products.

Chapter X Implementation Provisions

This chapter covers transitional provisions, effective dates, terms of reference, and enforcement responsibilities.

 Comparative Table of Administrative Procedures

The MoH provided a comparative table of administrative procedures under the current legal document and the draft decree, primarily focusing on three policy areas: cosmetic product notification, cosmetic recall, and cosmetic production.
