China to Exempt Eligible Medical Devices and IVD Reagents from Clinical Evaluation or Trials

On Sept. 18, the National Medical Products Administration (NMPA) released the List of Medical Devices Exempted from Clinical Evaluation and the List of In Vitro Diagnostic Reagents Exempted from Clinical Evaluation. Both are scheduled to take effect on Oct. 1, 2021.

EU Regulates the Use Requirements of Deoxyarbutin and Dihydroxyacetone

In July the EU released the amendments to the annexes of Regulation (EC) No 1223/2009, of which deoxyarbutin (tetrahydropyranyloxy phenol) is newly prohibited for use in cosmetics, and dihydroxyacetone is newly allowed for a restricted use.

Intellectual property (IP) protection is a longstanding and critical concern for companies operating in China, which has also been a key point of contention in the US-China trade war. China has already made strides in recent years to improve IP protection as the government seeks to spur domestic Chinese innovation and improve the business environment for investment, such as revising its IP laws and establishing a new national IP appeals court. However, challenges remain, as counterfeiters and infringers are getting increasingly sophisticated. For example, infringers may take advantage of procedural loopholes and proactively seek to invalidate legitimate IP rights. Companies are thus suggested to develop a comprehensive strategy to identify and protect their IP in China. This includes enhancing internal controls and making the best use of external resources.

The original domestic and imported general cosmetics notification information management platform will be closed on Sep. 15, 2021. After that, the notifier will not be able to handle related notification matters through the original platform. The notification of general cosmetics that have not passed the post-notification review on the original platform (including those that have not undergone post-notification review, have not been corrected after being ordered to make corrections, have not yet meet the requirements after correction) will be canceled by the notification department.

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
China’s Safety and Technical Standards for Cosmetics (STSC) and Its Updates
The current cosmetic technical standard STSC 2015 specifies the cosmetics' general safety standards, prohibited/restricted/permitted ingredients and testing methods.
