Reduction of Cosmetic Consumption Tax: Good News for CBEC

Background: This April China implemented a new tax system for CBEC commodities, which replaced 50 % of personal postal article tax with a new rate related to consumption tax, value-added tax and tariff shown as below: Purchasing value Rate Per order value ≤ 2000 RMB (after tax) 70% * (17% of value-added tax + 30% of consumption tax) Annual purchasing value ≤ 20,000 RMB (after tax) Per order value > 2000 RMB (after tax) 2%-10% of Tariff + 17% of value-added tax + 30% of consumption tax Annual purchasing value > 20,000 RMB (after tax) Since Oct 1 China cosmetic consumption tax has been reduced to 15% from 30% and is only applicable for “high-end cosmetics” including high-end makeup cosmetics, skin care cosmetics and cosmetic kits (see CL News on Sep 30). On Sep 30, China Ministry of Finance and State Administration of Taxation announced that from Oct 1 2016 the consumption tax for cosmetics will be reduced to 15% from 30%.

China CBEC H1 Import Data Reveals Reduced Growth

According to statistics released by China E-commerce Research Institutes, CBEC transactions in the first half of 2016 reached 2.6 trillion RMB representing an increase of 30% compared with last year. However the total value of CBEC imports accounted for 512.5 billion RMB or 19.6% of total CBEC transaction value, up 7.4% from the previous year.

Guangdong Launches Crossborder Ecommerce Traceability System

Recently Guangdong province launched a CBEC traceability system which streamlined with the current e-port platform*. Every commodity on the platform is issued an individual QR code. Consumers can scan the QR code and find 21 categories of information such as origin, manufacturer, filing number, CBEC company name and logistics information.

China Clarifies Sunscreen Labeling Requirements

CFDA’s announcement on June 1 relating to new sunscreen labeling requirements indicated that when measured SPF is between 2 and 30, products shall be marked with the measured value. The clause on labelling requirements is particularly confusing for both consumers and manufacturers which neglect the possible SPF error measured by the testing institutions. To respond to industry’s concern, on Aug 15th CFDA released a notification to further specify the labeling requirements. According to the notification, products with SPF≥2 are subject to the following rules: Measured SPF =2-5 (including 2 and 5): indication of the actual measured value Measured SPF=6-50 (including 6 and 50): the maximum labeling SPF shall be actual measured value; the minimum labeling SPF shall be the smaller number comparing the lower limit of 95% confidence intervals of the actual measured value with the largest integer (less than the actual measured value) of multiple of 5 Me

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
