China Releases Enforcement Rules for Filing of First Import Non-special Use Cosmetics through Shanghai Pudong

China Details Cosmetic License Renewal Requirements

China Food and Drug Administration released the amended provisions for renewal of cosmetic license for public consultation. The consultation period will end on Dec 31. In the past, there was only one clause in the Provisions for Application and Acceptance of Administrative Licensing for Cosmetics regulating the renewal of cosmetic license which stipulated that “Applicants intending to extend the validity must apply 4 months prior to the expiry date”. The new provisions adjust the deadline to apply for renewal and detail the application procedures and requirements. New Provisions 1. Take home: Domestic Manufacturers shall exchange or obtain a Cosmetic Production License before Dec 31 2016. On Dec 15 2015 CFDA announced the consolidation of the cosmetic licensing system. Domestic manufacturers will no longer need to obtain a Cosmetics Production License from AQSIQ and a Hygiene License for Production Enterprise of Cosmetics from provincial FDAs and will now only need a Cosmetic Production License from provincial FDAs (see CL news).

China Clarifies Sunscreen Labeling Requirements

CFDA’s announcement on June 1 relating to new sunscreen labeling requirements indicated that when measured SPF is between 2 and 30, products shall be marked with the measured value. The clause on labelling requirements is particularly confusing for both consumers and manufacturers which neglect the possible SPF error measured by the testing institutions. To respond to industry’s concern, on Aug 15th CFDA released a notification to further specify the labeling requirements. According to the notification, products with SPF≥2 are subject to the following rules: Measured SPF =2-5 (including 2 and 5): indication of the actual measured value Measured SPF=6-50 (including 6 and 50): the maximum labeling SPF shall be actual measured value; the minimum labeling SPF shall be the smaller number comparing the lower limit of 95% confidence intervals of the actual measured value with the largest integer (less than the actual measured value) of multiple of 5 Me

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
