Canada Proposes to Require Cosmetics to Be Labeled with Fragrance Allergens

On Feb. 11, 2023, Health Canada (HC) published the Canada Gazette, Part I, Volume 157, Number 6. According to the Gazette, the Government of Canada plans to amend Cosmetic Regulations, requiring cosmetics to be labeled with fragrance allergens, allowing the disclosure of the full ingredient list of cosmetics sold in small packages on the website, and modifying cosmetic supervision requirements. Stakeholders can mail any suggestions to cosmetics@hc-sc.gc.ca before Apr. 22, 2023.

New Zealand Consults on the Revised Cosmetic Products Group Standard 2020, a Blanket Ban on PFAS Included

On March 2, 2023, New Zealand's Environmental Protection Authority (EPA) released a new draft of Cosmetic Products Group Standard 2020 (the Standard) for public consultation. The new draft expands its applicable scope to non-hazardous products containing hazardous ingredients, updates the ingredient lists to align with the latest amendments adopted by EU, modifies labelling requirements, and requires the record keeping of nanomaterial.

Canada Proposes to Require Cosmetics to Label Certain Toxic Substances

On Oct. 29, 2022, Canada published the Canada Gazette, Part II, Volume 156, Number 44, including a Notice of Intent on the Labeling of Toxic Substances in Products. According to the notice of intent, the Government of Canada plans to require certain products (including cosmetics) to label the information on substances listed in the List of Toxic Substances (Schedule 1) of CEPA.

EU to Adopt Six Changes to the Use Requirements for Cosmetic Ingredients

On November 11, 2022, the EU introduced new amendments to the use requirements for cosmetic ingredients in Regulation (EC) No 1223/2009. All amendments aim at the lists of restricted ingredients and permitted UV filters, including adding two restricted ingredients and two permitted UV filters, and amending the use requirements for one restricted ingredient and one permitted UV filter.

It emphasizes that using terms such as "ingredient submission code obtained" to falsely claim that the ingredients have been approved or recognized by regulatory authorities is suspected of false or exaggerated publicity, and will be investigated and punished.

Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
