Registrants/notifiers located in Hong Kong, Macao and Taiwan or outside of China. The responsible person in China must be an enterprise as a legal person, not a natural person.

Please pay attention to the following two special cases:
(1) If an overseas company A entrusts a Chinese company B to produce and sell products in China, company A needs to designate a responsible person in China.
(2) If a Chinese company A entrusts an overseas company B to produce imported products, company A is the registrant/notifier and does not need to designate a domestic responsible person.
Article 32 of the Cosmetic Supervision and Administration Regulation clearly states: "Cosmetics registrants, notifiers and entrusted production enterprises shall have the quality and safety responsible personnel to undertake corresponding product quality and safety management and product release duties. The person in charge of quality and safety shall have professional knowledge related to the quality and safety of cosmetics and more than five years of work experience in cosmetic production or quality and safety management. "
Parties excluding cosmetics registrants, notifiers, and entrusted manufacturers can decide whether to set up the responsible person according to their management needs.
According to the Administrative Measures on Cosmetics Labeling, cosmetics shall bear the Chinese product name. Special cosmetics shall bear registration certificate number. For the notification number of general cosmetics, the enterprise can decide whether to mark it or not.
In principle, it should be listed according to the IECIC 2021, and other notification documents (such as the original packaging's translation, Chinese label, etc.) involving the ingredient names should be consistent with those in the formula.
If the ingredient names of the formula that has been submitted for testing are inconsistent with those of the formula submitted on the notification and registration platform, the reason should be explained.
Such situation is allowed, but when the registrant/notifier uploads the testing report, the person should also upload a scanned copy of the certificate of appointment by the registrant/notifier.
The information shall be compiled and uploaded in one file.
Information of all the ingredients of compounds (including plant extracts) should be submitted. For example, for Kathon, the content of methylchloroisothiazolinone, methylisothiazolone, water, magnesium chloride, and magnesium nitrate should be provided.
The ingredient's purpose of use should be truthfully marked in the formula according to the actual production situation and should be consistent with the chemical properties of the ingredient and the formula system.
After a new cosmetic ingredient has been registered or notified, the National Food and Drug Administration will publish the relevant information of the new cosmetic ingredient to the public. If cosmetics registrants and notifiers use any new cosmetic ingredient to produce cosmetics, they should fill in the new cosmetic ingredient's registration or notification number when registering and notifying cosmetics. Only after the confirmation from the ingredient registrant or notifier through the online platform, they can submit the registration or notification dossiers. In addition, they shall monitor the use and safety conditions of the new ingredient used in accordance with the requirements of the Administrative Measures on Cosmetic Registration and Notification.
If a new cosmetic ingredient is ordered to be suspended during the safety monitoring period, the registration and notification information service platform will automatically identify the cosmetics using the new cosmetic ingredient and generate a reminder. The relevant cosmetic registrants and notifiers should suspend the production and operation of these cosmetics.
"Avoid applying to eyes/avoid contacting with eyes " is not equivalent to "avoid applying to area around eyes". For skin care products used on the face (except masks and sprays) that clearly mark "avoid applying to area around eyes" on the Chinese label and the product technical requirements document, the acute eye irritation test can be exempted.
If a product formula contains cosmetic ingredients that have restrictions on the pH value (such as α-hydroxy acid, sodium hydroxide, etc.), it is necessary to clarify the control requirements of pH or submit the related testing report.
For products that
claim to contain α-hydroxy acid or
not claim to contain α-hydroxy acid but the total amount of α-hydroxy acid is ≥3% (w/w)
they are required to test the α-hydroxy acid and the pH value.
