Korea is amending Article 3 of "Cosmetic Act", redefining the scope and penalties associated with a manufacturer's staff found using illegal recreational drugs.

In the past Korea's overarching regulation the "Cosmetic Act" stipulated that manufacturers with certain staff found to be addicted to drugs and other toxic substances would be disqualified and banned from manufacturing. The provisions of this article were too vague making practical management and supervision difficult. In order to ensure legal clarity, it is proposed to further clarify the definition of "other toxic substances".

MFDS issued a draft to revise Article 3, Item2, No.3 "drugs and other toxic substances" to a more detailed definition as "addicted to opioids, cannabis, and psychotropic drugs". The draft is under public consultation. Once the final revision is promulgated, it will enter into force immediately.
