On January 25, 2025, Canada published Canada Gazette, Part I, Volume 159, Number 4: Government Notices, which includes a Significant New Activity (SNAc) Notice for trisiloxane (3-ethyl-1,1,1,3,5,5,5-heptamethyl-, CAS No. 17861-60-8). 1
Trisiloxane is not listed on Canada’s Domestic Substances List. The government suspects that its use in certain cosmetic applications may pose risks, particularly concerning reproductive, developmental, and oral toxicity. Consequently, companies intending to undertake a SNAc involving this substance must submit a Significant New Activity Notification (SNAN) at least 90 days in advance, providing detailed safety data.
Scope of SNAc
1. Scope of a SNAc
1) The use of trisiloxane in the manufacture of a cosmetic other than:
Hair dye containing the substance at 5% by weight or less;
Rinse-off cosmetics (e.g., shampoos, facial cleansers) containing the substance at 10% by weight or less; or
Foundation makeup, facial makeup remover, hair gel, or lipstick containing the substance at 1% by weight or less.
2) The distribution for sale of trisiloxane if contained in a cosmetic other than those listed above.
Exemptions apply when the substance is used exclusively for research and development, as a site-limited intermediate, or in products intended solely for export.
2. Transitional Measures
A transitional provision is in place. Between January 25, 2025, and January 24, 2026, a SNAc refers to:
The use of trisiloxane in quantities exceeding 100 kg in the manufacture of a cosmetic other than those listed above;
The distribution for sale of trisiloxane in quantities exceeding 100 kg if contained in a cosmetic other than those listed above.
Information to be Submitted
Companies planning to engage in a SNAc involving trisiloxane must submit a SNAN at least 90 days prior to using the substance for the SNAc. The submission must include the following information:
1. A description of the proposed activity 2. Anticipated annual usage quantity of the substance to be used 3. Information required under Schedule 4, paragraphs 7(c) and (d) and Schedule 5, paragraphs 8(f) and (g) of the New Substances Notification Regulations (Chemicals and Polymers). 4. Substance function 5. Test data and reports
6. A summary of all other available information and test data relevant to environmental and human health risks. 7. Names of government agencies (in or outside Canada) that received information on the substance, along with any known file numbers, assessments, and risk management actions. 8. Name, address, phone number, and email of the applicant. If the applicant is not a Canadian resident, details of an authorized Canadian representative must be provided. 9. A signed and dated declaration confirming the accuracy and completeness of the submitted information. |
The Department of the Environment and the Department of Health will conduct a risk assessment within 90 days of receiving the complete submission to determine whether the activity can proceed under regulatory safeguards.
