Starting January 1, 2025, obtaining the “Approval Certificate for Import and Export of Controlled Chemicals” and the “License for Import and Export of Dual-use Items and Technologies” will no longer be required for two categories of products: 1) non-medical disinfectants, synthetic detergents, cosmetics, inks, and similar items, and 2) related products containing TEA at a concentration of 10% or lower, excluding single aqueous solutions of TEA. Taiwan’s Amendments of the List of Prohibited Ingredients in Cosmetics to Take Effect

On March 21, 2024, Taiwan FDA introduced   finalized amendments to the List of Prohibited Ingredients in Cosmetics. Compared to the previous list, the amended version newly includes nine prohibited ingredients. These ingredients have already been banned for use in cosmetic products in ASEAN and EU. To align with international regulations, TFDA newly introduces their prohibition. Additionally, TFDA revises the use conditions of two existing ingredients.

 

The majority of the amendments are set to take effect on January 1, 2025.

Transitional Policy for the Market Entry of Products Containing Homosalate to Expire

On November 11, 2022, the EU introduced six changes to the ingredient lists in Cosmetics Regulation, including:

  • Addition of two restricted ingredients and two permitted UV filters;

  • Amendments to the use requirements for one restricted ingredient and one permitted UV filter.

 

Notably, the revisions affect the application scope and maximum concentration of Homosalate. From January 1, 2025, cosmetic products containing Homosalate that do not comply with the conditions shall not be placed on the Union market. From July 1, 2025, such products must not be made available on the market.

California’s Bans on Harmful Chemicals in Cosmetics to Take Effect

On September 30, 2020, California enacted the Toxic-Free Cosmetics Act (Assembly Bill No. 2762), which prohibits 13 specific PFAS compounds and 11 other harmful chemicals in cosmetics.


Subsequently, on September 29, 2022, California passed Assembly Bill No. 2771, which expands the prohibition by disallowing the manufacture and sale of any cosmetics with intentionally added PFAS. This bill defines PFAS as a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom. Both Assembly Bill No. 2762 and Assembly Bill No. 2771 are set to take effect from January 1, 2025.

Maryland’s Bans on Harmful Chemicals in Cosmetics to Take Effect

On May 30, 2021, Maryland enacted House Bill 0643, which mirrors California's AB 2762 by prohibiting the manufacture, sale, and distribution of cosmetic products containing the same 24 toxic chemicals from January 1, 2025. Minnesota’s Bans on Sales of Specific PFAS-Containing Products to Take Effect

On May 24, 2023, the governor of Minnesota signed HF 2310, a bill encompassing policies on environment, natural resources, climate, and energy. The legislation includes a broad ban on PFAS, defined as a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom.

 

Effective from January 1, 2025, Minnesota will prohibit the sale, offering for sale, and distribution of 11 product categories containing intentionally added PFAS, including cosmetics, carpets or rugs, cleaning products, and cookware. For the purposes of this law, "cosmetic" includes products intended as components of other cosmetics but excludes soap.

Colorado’s Bans on Sales of PFAS-Containing Consumer Products to Take Effect

On June 3, 2022, the Governor of Colorado signed the Perfluoroalkyl and Polyfluoroalkyl Chemicals Consumer Protection Act (HB 22-1345) into law, prohibiting the sale and distribution of certain products with intentionally added PFAS chemicals, including cosmetics. The ban will be phased in, with the sales ban on cosmetic products scheduled to take effect on January 1, 2025.

Washington to Restrict the Use of Certain Toxic Chemicals in Consumer Products

On May 15, 2023, Washington passed HB 1047. As per the bill, effective January 1, 2025, the manufacture, sale, and distribution of cosmetics containing eight specified chemicals and chemical classes are prohibited in Washington. These restricted substances include ortho-phthalates, PFAS, formaldehyde and formaldehyde releasers, methylene glycol, mercury, triclosan, m-phenylenediamine and its salts, and o-phenylenediamine and its salts. Retailers within the state are provided with a one-year sell-through period to deplete the existing stock by January 1, 2026.

Sri Lanka

Sri Lanka to Update Labeling Requirements for Borderline Products

On October 22, 2024, Sri Lanka’s National Medicines Regulatory Authority (NMRA) announced a series of revised labeling requirements for borderline products, i.e., items with combined characteristics of medicines, foods, medical devices, or cosmetics. Under the new rules, each commercial pack must have a non-peelable or printed sticker displaying “NMRA approved,” along with details of the market authorization holder and the product’s retail price.

 

These requirements apply to all batches released on and after November 1, 2024, with exemption on products in the market produced prior to November 1. A three-month grace period is provided for compliance for both local and imported products, after which adherence to the new labeling standards will be mandatory.

On March 15, 2024, the EU updated the ingredient lists in Cosmetics Regulation, introducing the following requirements:

  • Ban on 12 nanomaterials;

  • Restriction on Hydroxyapatite (nano) in cosmetics.

 

These amendments took effect on April 4, 2024, with a transitional period. Starting February 1, 2025, cosmetic products containing the newly banned or newly restricted nanomaterials and not complying with the restrictions shall not be placed on the Union market. From November 1, 2025, such products must not be made available on the market.

On April 4, 2024, the EU updated the ingredient lists in Cosmetics Regulation, introducing the following changes:

  • Amending the use requirements for two permitted preservatives;

  • Deleting one permitted UV filter.

Changes to ACD Ingredient Annexes

The 37th ASEAN Cosmetic Scientific Body (ACSB) meeting, held on May 8–9, 2023, adopted amendments to four ingredient annexes under the ASEAN Cosmetic Directive (ACD). These amendments, set to take effect on May 8, 2025, mainly include:

1) Annex II – List of Prohibited Ingredients: 19 entries added

2) Annex III – List of Restricted Ingredients: 2 entries added

3) Annex VI – List of Permitted Preservatives: 1 entry revised

4) Annex VII – List of Permitted UV Filters: 1 entry revised

Additionally, during the 38th ACSB meeting on November 15 and 21, 2023, the preservative Methenamine 3-chloroallylochloride was removed from Annex VI. This removal will also take effect on May 8, 2025.

On June 26 and June 28, 2024, the Taiwan Food and Drug Administration (TFDA) announced the finalized Cosmetic Categories Required to Establish the Product Information File (PIF) and Effective Dates, as well as the Cosmetic Categories for Which Manufacturing Premises Shall Comply with Cosmetics Good Manufacturing Practice Regulations. The PIF document took effect on July 1, 2024, while the GMP compliance document took effect on June 28, 2024.

 

Starting July 1, 2025, enterprises of baby products, lip products, eye products, and non-medicated toothpaste and mouthwash must establish a PIF and comply with GMP requirements.

Transitional Policy for the Labeling of Sunscreen Aerosol and Spray Pump to Expire

Australia's Therapeutic Goods Administration (TGA) announced on April 11, 2024, the integration of the Australian/New Zealand Standard: Sunscreen Products – Evaluation and Classification (AS/NZS 2604:2021) (referred to as the "2021 Sunscreen Standard") into the regulatory framework for therapeutic goods. This revised standard supersedes the previous 2012 version, setting forth comprehensive testing and labeling prerequisites for sunscreens available in the Australian market.

 

In conjunction with this integration, the TGA introduced transition arrangements. Notably, existing aerosols and spray pump packs listed in the Australian Register of Therapeutic Goods (ARTG) before July 1, 2024, must be compliant with the updated labeling mandates specified in the 2021 Sunscreen Standard before July 1, 2025.
