China Implements New Labeling Requirements for Sunscreens

On June 1 2016 China Food and Drug Administration promulgated and implemented a regulation named “Requirements for Sunscreens Labeling”, revising the labeling requirements relating to SPF and PFA. The most significant change to the new regulation is the permission of marking SPF > 50 and PA ++++ on labels. In the past cosmetics can only be indicated by SPF > 30 and PA +++ even if the actual measured value is higher, which doesn’t align with the international standards. ... Reach24h’s Interpretation: For imported sunscreens, new claims can be marked on over-labels without the need of updating original packaging. The regulation mentioned that “measured SPF = 2~50, indication of the measured value”. It can be expected that SPF 13, 24, 48, etc will appear on labels and SPF value will be different between over-labels and original packaging due to deviation, which may confuse consumers. Cosmetic Registration in India Goes Online

From 6 June 2016 cosmetic registration in India must be submitted online. On 30 May India Central Drug Standard Control Organization (CDACO) announced that from 06 June the registration for cosmetics have to be mandatorily filed online through its e-portal.

China to Assess New Supervision Model during CBEC Transition Period

China will assess new supervision models for CBEC but would not forgo registration or filing requirements for products under the pre-market approval system. Updates on Ban of Repackaging of Cosmetics

The news that repackaging will be no longer be permitted in China has garnered huge attention in the media and many cosmetic companies have taken extra steps to confirm this with local FDAs. China Officially Grants One-year Grace Period for CBEC

On 25 May 2016, China GAC released a notice specifying new supervision requirements for CBEC retail imports. Under the new announcement CBEC stakeholders have been given a “green light” until 11 May 2017 for their products. Within the buffer period it will be business as usual except for the implementation of the new tax policy and positive list. Import procedures will remain the same as before which forgo complicated application documents for CIQ inspection, Chinese labels, pre-market approval documents, etc.

Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025.
