Thailand FDA to Reinforce Cosmetic Advertisement Regulation

Thailand FDA is currently drafting a regulation to identify prohibited messages in cosmetic advertisements and is going to give harsher punishment to violators. The finer points of the regulation are currently being considered by the FDA cosmetics committee and new guidelines are expected to be completed this year.

Consumers Alerted to Avoid Cosmetic without Chinese Label

Regulatory experts had warned that lack of Chinese label for imported cosmetics should be avoided after a local FDA launched investigation into a suspected counterfeit case that allegedly involved hundred batches of Korean cosmetics, following a recent customer complaint where the user suffered from skin rash.

Taiwan Needs Stricter Cosmetic Regulation and Enforcement

The Consumers’ Foundation in Taiwan tested 25 types of perfume and 25 types of nail polish at the Electronics Testing Center and a laboratory in National Tsing Hua University. Among those cosmetics, three perfumes contained di (2-ethylhexyl) phthalate (DEHP), including one exceeding the legal limit, while eight products contained diethyl phthalate (DEP), which also poses potential health and safety risks.

Korean Parliament Proposes Revision to Cosmetic Law

China Makes Significant Changes to the Overarching Cosmetic Regulation

On July 20th 2015, the Legislative Affairs Office of China State Council promulgated the second version of the draft Regulation concerning Supervision and Administration over Cosmetics for public consultation. The period of public consultation will end on August 20th. China State Council is responsible for the issuance and implementation of this China overarching cosmetic regulation. This round of consultation could be a rare chance (maybe the last chance before its issuance) for all stakeholders to give comments and make requests.

Implementation of Administrative Measures on Cosmetics Labeling Put on Hold

Last November China Food and Drug Administration released the draft Administrative Measures on Cosmetics Labelling for public comment. According to the draft, all the regulatory requirements outlined in the draft were to be formally implemented by July 1 2015. Cosmetics already circulated on the market were to comply with the regulation from June 30 2016. However, the deadlines outlined in the draft have not been met and the CFDA has not released any information on the actual promulgation date of the finalized regulation.

On September 2nd 2003, on behalf of the Government of Vietnam, the Vietnam Minister of Trade and Commerce signed an agreement on the ASEAN harmonized Cosmetic Regulatory Scheme, in which, the terms specified in the agreement is fully implemented since January 1st 2008. The agreement aims to unify cosmetic management in the ASEAN countries, and is toward a common market of ASEAN, strengthen cooperation between member States in ensuring safety, quality and beneficial feature of all cosmetic products on the ASEAN market and remove the restrictions on the cosmetic business between member States through the harmonization of technical regulations...

Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
