Three Significant Changes Worthy of Attention in Technical Safety Standard for Cosmetics

On August 12th, CFDA opened Technical Safety Standard for Cosmetic for public consultation. The new standard “Technical Safety Standard for Cosmetics” replaces the Hygienic Standard for Cosmetics (2007). Articulated within the standard are significantly reduced maximum impurity level requirements, stricter requirements for children’s cosmetics and an appended list of prohibited substances which has an additional 100 substances added.

Public Consultation Resumed for New Draft of Cosmetic Safety Technical Standard

Amendments to the new draft of Cosmetic Safety Technical Standard have kicked off the second phase of public consultation after the first ended this February. The Registration Division of CFDA released a notice on 12 August, calling for the bulky guidance to undergo a further round of public feedback before 1st of September.

China Makes Significant Changes to the Overarching Cosmetic Regulation

On July 20th 2015, the Legislative Affairs Office of China State Council promulgated the second version of the draft Regulation concerning Supervision and Administration over Cosmetics for public consultation. The period of public consultation will end on August 20th. China State Council is responsible for the issuance and implementation of this China overarching cosmetic regulation. This round of consultation could be a rare chance (maybe the last chance before its issuance) for all stakeholders to give comments and make requests.

China to Update Inventory of Existing Cosmetic Ingredients 2014

On June 16 2015, China Food and Drug Administration announced it is to append the Inventory of Existing Cosmetic Ingredients in China 2014 (IECIC). A draft list of 147 ingredients was released for public consultation. The period for public consultation will end on June 25.

Chinese Authorities Warn Consumers of Risks Associated with Injectable Sodium Hyaluronate Products

China Food and Drug Administration recently discovered beauty parlors and medical beauty institutions selling or using counterfeit or illegal injectable sodium hyaluronate products. Consumers are advised to excercise caution when using injectable sodium hyaluronate products and go to beauty parlors officially certified with a license to give such treatments.

China National Standard: Determination Methods of Three Prohibited Cosmetic Ingredients

National standard “GB/T 30942-2014 Determination of 2-methoxyethanol, 2-ethoxyethanol and 2-(2-methoxyethoxy) ethanol in cosmetics”, formulated by Fujian Institute of Quality Inspection and Technical Research entered into force recently. The standard specifies the determination methods of the three ingredients in cream, lotion and liquid products. According to the standard, the detection limit of these ingredients is 15mg/kg and the limit of quantitation is 50mg/kg.

New Draft of China Cosmetic Safety Standard

Data compiled on January 21st, 2015 revealed that the number of the enterprises granted a cosmetics production license certificate was 3880, and the number of individual licensed cosmetic products was 275,127. With the rapid development of China's cosmetics industry the current cosmetics safety standard "Hygienic Standard for Cosmetics 2007" (hereinafter "the Standard 2007") lacks the specific provisions to adequately regulate China's industry evidenced by the large number of cosmetic related adverse events reported by the CFDA since it took over regulatory responsibility from the MoH. In an effort to remedy this situation the National Institutes for Food and Drug Control (NIFDC), commissioned by CFDA, revised the Standard, and published the "Safety Technical Standard for Cosmetics (draft)" for comments on February 3, 2015 for public consultation...

China Drafts Cosmetic Technical Safety Standard

In an effort to develop regulatory protocols and standards which match the technical and supervisory capacity of the cosmetic industry, the CFDA is revising the 2007 Hygienic Standard for Cosmetics. To date the most significant progress made in amending this standard was the release of the revised body of the 2007 Hygienic Standard (renamed Technical Safety Standard for Cosmetics) in 30 Nov 2012. Since January 2014 the CFDA has coordinated with the National Institutes for Food and Drug Control (NIFDC) in a further revision of this draft. Following over a year of detailed revision work, the NIFDC is now soliciting opinions from the public on the new draft of the Technical Safety Standard for Cosmetics. The period for public consultation will end on February 28 2015. CFDA Consults on Draft Regulations concerning the Supervision and Administration of Cosmetics

In the second half of 2013, CFDA began reforms of Regulations concerning the Hygiene Supervision over Cosmetics in order to further standardize the production and operation of cosmetics, reinforce the supervision and administration of cosmetics, ensure the quality of cosmetics and safety and safeguard consumers’ health. On November 8 2014, CFDA started to solicit public opinion on the revised version, renamed Regulations concerning the Supervision and Administration over Cosmetics. The regulation gives clear provisions for filing or registration of cosmetic ingredients and products, production of cosmetics, labeling and advertisement as well as supervision over cosmetics throughout the supply chain. Once this regulation comes into effect, the Regulations concerning the Hygiene Supervision over Cosmetics shall be repealed simultaneously.

Stay Current: China’s Cosmetic Safety Assessment Regulatory Landscape
Under the current regulatory framework, cosmetics registrants and notifiers can continue to submit a simplified version of the safety assessment report during the registration or notification process until May 1, 2025. Following this deadline, a full version of the safety assessment will be mandated. To facilitate a smooth transition, China is planning to release a set of technical guidelines.
