After 30 years of waiting, China finalized the Cosmetic Supervision and Administration Regulation (CSAR) on Jun 29, 2020. It will be implemented on Jan 1, 2021 and a series of supporting rules will be introduced, indicating the overhaul of China’s cosmetic regulatory framework. Stakeholders are now ushering in a new era of streamlined management.
CSAR (short for Cosmetic Supervision and Administration Regulation) is the highly anticipated future overarching regulation in China. The final version was released by China State Council on June 29, 2020 and will be implemented on January 1, 2021. It will replace the existing Cosmetics Hygiene Supervision Regulation which was released in 1989.
Cosmetic ingredients will be regulated based on risks. Ingredients with high risk such as new preservatives, sunscreens, colorants, hair dyes, whitening agents shall register with NMPA and obtain approval, while ingredients with low risk will only require filing certificates.
CSAR subordinate regulation released a signal that imported non-special use cosmetics will be likely to be exempt from mandatory animal testing. The 2 premises for animal testing exemption are GMP certification and safety risk assessment results.
Cosmetic efficacy claims shall have sufficient scientific evidence to back them up and shall be exposed to the public on NMPA’s website for social supervision. Cosmetic registrants or filers shall be responsible for the compliance of efficacy claims.
Cosmetic enterprises shall be responsible for the safety and quality of their products. Their obligations will include carrying out safety assessment, reporting the usage and safety information of new cosmetic ingredient, recalling substandard cosmetics, etc.
